Complaints Against Sirius XM Radio Settled

Virginia Attorney General Mark Herring and other states have reached a settlement with Sirius XM radio over misleading advertising, billing and cancellation practices. The satellite service has agreed to pay restitution directly to eligible customers and pay $3.8 million to the states that filed the lawsuit.

An investigation followed complaints that Sirius XM automatically renewed customer contracts without their knowledge or consent, and failed to honor cancellation requests. The radio service also was accused of higher unanticipated rates after a low introductory rate, and failing to provide timely refunds, among other practices.

Sirius XM customers may be entitled to restitution if they had a loss between July 28, 2008 and December 4, 2014. Consumers must file a complaint by May 3, 2015 to be eligible for restitution. They can be filed with Sirius XM online at http://www.siriusxm.com/settlementprogram or sent by mail to P.O. Box 33059, Detroit, MI 48232-5059. Virginia consumers who want to file with the Attorney General’s Office may do so online, or may download a complaint form to be completed and returned to: Office of the Attorney General, Consumer Protection Section, 900 East Main St., Richmond, VA 23219, or faxed to (804) 225-4378. Complaint forms can also be requested by calling the Attorney General’s Consumer Protection Hotline at (800) 552-9963.
